TicketExchange Selling Policy

We hope you enjoy using Ticketmaster's TicketExchange service. The following TicketExchange Selling Policy (the "TicketExchange Selling Policy") sets out the terms and conditions which will legally bind you and Ticketmaster if you post tickets for sale through TicketExchange. By posting tickets, or otherwise using this website, you agree to be bound by this TicketExchange Selling Policy. 1. Ticket Elegibility

Due to restrictions set by UK laws, regulations, industry codes of practice, event promoters, artists or venues, TicketExchange may not allow certain types of tickets, or tickets to certain events, to be posted for sale. If your ticket is not eligible for posting, TicketExchange will not permit it to be posted on the Site.


2. Process of Posting a Ticket
  • Account Information: You will need to set up an account with TicketExchange in order to post tickets use TicketExchange. To cover potential refunds, the account information required will include your credit card and current account information. Once you have the account set up, you will be able to log in. As you post tickets for sale, you will be asked to provide certain additional information which will be used to set the number, posting price and any other restrictions (where applicable) relevant to the tickets.
  • Number of Tickets in Posting: You will be asked how many tickets you are trying to sell through the posting, and you will be required to enter codes used to identify the tickets you are trying to sell. All tickets that you post in a single posting must be for adjacent seats at the same event.
  • Selling Multiple Tickets: Purchasers will be obliged to purchase all tickets in the posting. Consequently, you may wish to split tickets up into multiple postings to increase your chance of selling your tickets. For instance, if you hold tickets for six adjacent seats to an event, you may wish post them in two groups of three, or three groups of two, if you believe that doing so will increase the chance that you will sell all of your tickets.
  • Checking Adjacent Seat Numbers: If you are planning on splitting a group of tickets into multiple postings, or planning on trying to sell only some of your tickets (and keeping the rest for personal use) you should pay attention to the seat numbers of the remaining tickets that are not part of that posting, and make sure that all the remaining tickets are for adjacent seat numbers.
  • Setting the Posting Price: Depending on the instructions of the event promoters, the venue, the artist or the Society of Ticket Agents and Retailers ("STAR"), either you will be able to select your own per ticket "Posting Price" for the tickets or a Posting Price will be automatically set for the tickets at the face value of the tickets you purchased plus the original Service Charge booking fee. It will not include the Order Processing delivery fee which has already been incurred. Limits on the Posting Price may be imposed or required by the event promoter, the venue, the artist or by the STAR.
  • Your Proceeds from a Sale: "Your Proceeds" in connection with a sale are equal to the Posting Price less a Posting Fee of 10% of the Posting Price, which Ticketmaster will deduct and retain in consideration for providing the TicketExchange service. The final purchaser will pay Ticketmaster the Posting Price plus the usual Ticketmaster Order Processing Fee for the transaction (but not the per ticket Service Charge as this is already included in the Posting Price). Other than Your Proceeds, Ticketmaster will keep all other amounts associated with a purchase and may share such amounts with third parties.
  • Date after which your tickets cannot be sold: Each ticket posting will have an "Expiration Date", which we will set to ensure transactions can be processed and tickets can be delivered in sufficient time before the event. If a ticket posting is not ordered by a purchaser on or before its Expiration Date, then the posting will be terminated and the tickets in the posting will no longer be on sale. You will remain the holder of the tickets and be able to use them to attend the event.
  • Loss of the right to withdraw your tickets from sale: You will be able to delete your ticket posting, by logging on to Ticketmaster.co.uk and entering your user name, password and additional information associated with your posting, right up to the time that a purchaser orders the tickets. If you change your mind about selling the tickets, simply delete the ticket posting before the tickets are ordered. Once a purchaser orders the tickets in a posting, however, you will not be able to modify or cancel the posting, or to prevent the purchaser becoming the ticket holder. At that point, you will no longer be able to use them and they will be cancelled.
  • DO NOT DISCARD YOUR TICKETS: It is possible that you may not succeed in selling your tickets and may need them to attend the event. Even if you sell your tickets, you will need to return them to us to collect your proceeds as described in paragraph 3 below.

3. How to Receive Your Proceeds of Sale

Remittance Form: If the tickets you have posted in a ticket posting are ordered, you will be instructed to print out a special form from our web site (a "Remittance Form"). You must complete the form in full, sign it, and send it to us at the specified address, along with your unused tickets. If your tickets are TicketFast® tickets, then you will need to send us a computer print out of your tickets; for paperless tickets, you only need to send the Remittance form. No tickets need to be sent in.

The Remittance Form must include your most recent credit card account and most recent current account information that we have on file for you. You must also sign the agreement saying that:

(a) you are the owner and are in possession of the tickets that you are selling through such ticket posting;

(b) you authorise us to deposit funds into your current account; and

(c) you will pay us, and you authorise us to charge your credit card, and/or to withdraw money from your current account: (i) if we are legally obliged to refund to the purchaser in connection with a cancelled event and your Posting Price was in excess of the ticket face value (plus Service Charges) (see paragraph 5) and/ or (ii) if we suffer losses or damages as a result of any fraudulent activity in which you are involved.

Your failure to pay any amount due and owing to us under paragraph 3 (c ) above, within five days of us giving you notice that you owe such amount, shall constitute a material breach of this Agreement.

Account Verification: You may also be required to help us verify the bank or credit card account information you give us, in order for us to pay Your Proceeds to you. [One of the procedures we may require you to follow in order to do this involves Ticketmaster making small deposits into your current account and then you telling us how much we have deposited].

We have the right not to pay you Your Proceeds until such time as we have received from you the amounts due a properly completed and signed Remittance Form, along with all of the tickets (or, for TicketFast tickets, a computer print-out) sold through such posting, and we have completed (to our satisfaction) authorisation and verification procedures on the credit card, current account, and other information you have provided in the Form.

When we pay Your Proceeds, we will have the right to do so by depositing them into the current account set out on the Remittance Form (or any other number that you give us). We have the right to refuse to issue you a cheque or credit your credit card, and to use such a deposit as our sole means of payment to you.

Taxes: You agree to accurately report and pay all, and Ticketmaster will not be responsible for paying any, income, sales and other taxes (if any) that are owed in connection with any sale of any of your tickets or any remission of funds by us to you.


4. Tickets
  • Invalidation of Sold Tickets: By posting a ticket using TicketExchange, you authorise us, when the ticket is purchased, to cancel and invalidate your right to use or convey the ticket, and you acknowledge that the posted ticket will then be invalid for entry to the applicable event by you or anyone else (other than the purchaser of the ticket via TicketExchange in its newly reprinted form (or any person lawfully receiving the ticket from such acquirer).
  • Collection of Ticket Sale proceeds: The purchaser pays for the tickets by submitting their payment details and authorisation to us. We will collect the funds from the purchaser and, once we have received the returned tickets and Remittance Form from you as described in paragraph 3 above, we will pay you Your Proceeds for the sale.
  • Use of tickets: You may not at any time place more than one posting for the same ticket on TicketExchange.
  • Cancelled or invalidated tickets will not be honored.

    You agree that you will not sell, convey, give away, forward, otherwise distribute, try to use, or take any action that directly or indirectly allows it to be cancelled or invalidated:
(a) any ticket before or during any time that it is posted for sale on TicketExchange;

(b) any sold, forwarded or otherwise cancelled or invalidated tickets;

(c) any ticket that you have already sold, conveyed, forwarded or otherwise distributed to another; or

(d) any ticket that is owned by someone other than yourself. Please note that in some cases you may be obligated to return funds collected in connection with a sale, as described under the heading "Cancelled Events" above.


5. Cancelled, Postponed and Rescheduled Events

If an event for which you have posted a ticket becomes cancelled, postponed or rescheduled before you sell it through TicketExchange, we will remove your posting and our Purchase Policies continue to apply to that ticket.

Once you sell the ticket, our Purchase Policy will no longer apply to that ticket. If the event is later postponed, rescheduled or cancelled, you will still be required to return your original ticket(s) and completed Remittance Form.
  • If the event is postponed or rescheduled, you will still receive Your Proceeds from your sale, subject to the terms of this TicketExchange Selling Policy.
  • If the event is cancelled and your Posting Price was face value you will be entitled to Your Proceeds but our Purchase Policy no longer applies to the tickets so you will not be entitled to a refund of any booking fees or Posting Fees. We will be responsible for refunding the Purchaser in accordance with our Purchase Policy.
  • If the event is cancelled and your Posting Price was above face value, instead of being entitled to receive Your Proceeds, you will only be entitled to receive the same amount of money you would have been entitled to receive (if any) under the Purchase Policy as if the Purchase Policy applied to you and your ticket. If we have paid you Your Proceeds in connection with a cancelled event, then you agree that we will have the right to recoup and deduct from Your Proceeds the difference between Your Proceeds and the amount that you would have been entitled to receive under the Purchase Policy . You agree that we will have the right to recoup this amount by charging your credit card, and that if we are unable, for any reason, to charge and collect from your credit card this full amount, then we will have the right to withdraw any such uncollected amounts from your bank or financial institution account. We may also request payment from you via written or oral notice. In such case, you will pay us in the payment form (e.g., cheque) by the date in the amount that we request.
  • Release of Claims: You understand that if we have to charge your credit card or withdraw funds from your current account in accordance with the paragraph above, you may exceed credit card authorisation limits, write cheques with insufficient funds, or not to be able to satisfy your monetary obligations.
  • Indemnity: You release, and agree to indemnify and hold, us (and our affiliates, and our affiliates' officers, directors, employees, agents and contractors) harmless from any liabilities, claims, costs or damages incurred as a result of us charging your credit card or withdrawing funds from your bank or current accounts, or causing you to exceed your credit limits or write cheques with insufficient funds.

6. Liabilities: Incorrect Payment Information; Disclaimers; Roles of the Parties; Additional Representations

You agree to the following:

(a) we have the right to charge you fees and costs associated with any incorrect bank account information you give us;

(b) if you give us incorrect, or someone else's, bank account or credit card information and we deposit or credit funds into it, we will not be liable to pay you such amounts, all of our liabilities to you for such amounts will be discharged, and you will look solely to the recipient for payment;

(c) neither we nor anyone else makes any guarantee that any tickets posted or ordered by you will be purchased through TicketExchange;

(d) in no event shall our (or our affiliates, employees, agents, licensees or other related parties') aggregate liability to you related to your use of TicketExchange exceed the amount (if any) of your proceeds due from a sale that occurs (where such use is that of posting, trying to post or selling) (i.e., we will not owe you any money where you post but don't sell, or try to post but don't sell, a ticket);

(e) in using TicketExchange to sell a ticket, you will be the ticket's seller; neither Ticketmaster nor the ticket's original issuer are the seller nor are we the buyer. We are only providing certain facilitation services related to your sale;

(f) you represent and warrant that you are the rightful owner of each ticket that you post for sale on TicketExchange, that no such ticket is subject to any charges, claims or other encumbrances, and that you are not a sponsor, team, artist, venue, performer or promoter associated with any event for which you are posting a ticket on TicketExchange, or any of their employees or agents; and

(g) you agree not to use TicketExchange for any illegal or fraudulent purpose, or to post or sell any tickets that you do not own and not to impersonate any person or entity, including without limitation, a ticket holder.
